A Study on Analysis and Improvement of the Fishermen¡¯s Accident Compensation Insurance

Abstract
This study aims to analyse the Fishermen`s Accident Compensation Insurance(FACI) and suggest policy alternatives. Since its introduction in 2004, it has been developed with institutional factors, including high government subsidy, expanded range of accident approval, and unusual benefit provisions. Nonetheless, the academic approaches with regard to FACI have been rare. By the institutional analysis, this study clarified that FACI was based on employer liability, examining the present condition of FACI with the range of accident approval and benefit provisions. The result shows that FACI does not match the nature of accident compensation insurance by prescribing ¡®non-occupational injury on board¡¯ in addition to occupational injury and non-occupational injury, bringing about either over- or under-compensation by cases. In addition, FACI pays benefit for missing persons and possession loss; the former has the purpose of bonus and the latter property insurance, but neither is appropriate for social insurance benefit. On the other hand, FACI has no provision for nursing and rehabilitation, which are essential in industrial accident compensation insurance. In conclusion, the range of accident approval and benefit provisions of FACI need to be adjusted to match the nature and purpose of accident compensation insurance.
